Terms and Conditions

Effective Date: 15 Oct 2024

Welcome! We're glad you're here. These Terms and Conditions govern your use of PracticeRAW® training services and website, operated by Labkom Co. Ltd., registered in Thailand. We've tried to make this as clear and friendly as possible, but if anything's unclear, just ask us.

By using our services or enrolling in our programs, you're agreeing to these terms. We know legal documents can be dense - we've done our best to keep this readable.

1. Training Services

1.1 What We Offer

We provide professional development workshops and training programs focused on systems thinking and the RAW Systems Work® methodology. Our programs are available in two formats:

– Online workshops: Live sessions via Zoom, with digital materials
– In-person workshops: Face-to-face sessions in Bangkok, Thailand and other locations

Each program includes exclusive materials, including our proprietary book "Emergent Systems Thinking and Authentic Practice with Right Attention: A Primer for Systems Work" by Victor Nuñez.

1.2 Who Can Participate

Our programs are designed for professionals including consultants, coaches, organizational leaders, and practitioners interested in systems thinking. You must be at least 18 years old to enroll.

We welcome participants from around the world. Our primary language of instruction is English, though we may offer programs in other languages from time to time.

1.3 Registration and Enrollment

To register for a program:

– Select your preferred session through our Acuity scheduling system
– Complete the booking form with accurate information
– Receive a confirmation email with payment instructions
– Complete payment to confirm your registration

Your spot is reserved temporarily upon booking, but registration is only confirmed once payment is received.

1.4 Program Schedules

Online workshops: Scheduled dates are confirmed at the time of booking. We send all materials and access details 48 hours before the session starts.

In-person workshops: We typically confirm these programs 1-2 weeks before the scheduled date, once we've secured the venue and reached minimum enrollment. You'll receive confirmation when the workshop is guaranteed to run, followed by payment instructions.

1.5 What's Included

All programs include:

– Access to the live workshop session
– Exclusive book: "Emergent Systems Thinking and Authentic Practice with Right Attention: A Primer for Systems Work" (digital PDF for online, printed paperback for in-person)
– Workshop handouts and tools
– Access to our participant community
– Post-workshop support resources

1.6 What We Expect From You

We want everyone to have a great experience, so we ask that you:

– Show up prepared and on time
– Participate respectfully and constructively
– Keep workshop content and materials confidential (see Section 5 on Intellectual Property)
– Respect other participants' privacy and perspectives
– Let us know if you have any accessibility needs or concerns

We're here to create a supportive learning environment for everyone.

2. Payment Processing

2.1 How Payment Works

We use Stripe to process all payments securely. When you complete your booking, you'll receive a payment link via email. Your registration is confirmed once payment is successfully processed.

We never see or store your credit card information-that's all handled securely by Stripe.

2.2 Regional Pricing

We offer pricing in multiple currencies to make our programs accessible globally. The currency options you see reflect regional pricing to account for purchasing power differences around the world.

2.3 Taxes and VAT

For participants in Thailand: All prices are subject to 7% VAT (Value Added Tax) as required by Thai law. This will be added to your total at checkout, and you'll receive a proper tax invoice.

For international participants: Prices are exclusive of any taxes that may apply in your jurisdiction. You're responsible for determining and paying any applicable taxes (VAT, GST, sales tax, etc.) in your country. We're a Thailand-based business and can only handle Thai tax obligations.

If you're a business and need specific tax documentation, just let us know-we're happy to help.

2.4 Payment Terms

Online workshops: Payment is required within 48 hours of booking. If we don't receive payment within this window, your reservation will be cancelled, and the spot may be offered to someone on our waitlist.

In-person workshops: Payment is required within 24 hours after we confirm the workshop will run (typically sent 1-2 weeks before the scheduled date).

2.5 Currency and Conversion

If you're paying in a currency different from your bank's currency, your bank or card issuer may apply conversion fees. We have no control over these fees or conversion rates-those are set by your financial institution.

The amount you authorize in Stripe is the amount we receive. Any additional charges come from your bank, not us.

2.6 Failed or Declined Payments

If your payment is declined, Stripe will notify you of the reason (insufficient funds, incorrect card details, etc.). You can try again with a different payment method or contact your bank to resolve the issue.

If we don't receive successful payment within the required timeframe, we may need to cancel your booking to make the spot available to others.

2.7 Payment Confirmation

Once your payment is successful, you'll receive:

– Confirmation email from Stripe with your receipt
– Confirmation email from us with your booking details
– Instructions for what happens next

Keep these emails-they contain important information about your program.

3. Cancellation and Refund

We value the relationship we build with each participant. While policies are necessary, we approach each situation with understanding and flexibility where possible. This policy helps set clear expectations while allowing us to work together when circumstances require it.

3.1 Program Formats and Cancellation Windows

We offer two formats with different cancellation timelines:

Online Workshops (Zoom):
– Cancellations allowed up to 48 hours before the program start time
– Materials (including exclusive eBook) are delivered 48 hours before the session
– Once materials are sent, cancellations are no longer possible through the booking system

In-Person Workshops (Bangkok/Thailand venues):
– Program confirmation sent approximately 2 weeks before the scheduled date
– Payment required within 24 hours of confirmation that the workshop will run
– Once you've paid and we've confirmed the workshop is guaranteed to run, your commitment is secured
– Cancellations after payment may not be eligible for refunds due to venue commitments and material preparation

Important: In-person workshop venues in Thailand typically require confirmation 1-2 weeks in advance, so we cannot guarantee a workshop will run until we reach minimum enrollment and secure the venue.

3.2 Refund Eligibility

For Online Workshops:

More than 48 hours before program start:
– Full refund available minus payment processing fees
– Cancel through the booking system or contact us directly

Less than 48 hours before program start:
– No automatic refunds available
– Exclusive workshop materials (including eBook "Emergent Systems Thinking and Authentic Practice with Right Attention: A Primer for Systems Work" valued at €42) will have been delivered
– The intellectual property and digital materials cannot be returned once accessed
– Contact us directly if you have extenuating circumstances-we review each case individually

After program has started:
– No refunds for any portion of the program

For In-Person Workshops:

Before payment (during enrollment period):
– You may withdraw your interest at no cost
– No payment has been processed

After payment but before workshop confirmation:
– If we cancel the workshop (insufficient enrollment, venue issues), you receive a full refund
– If you cancel after paying, refunds considered on a case-by-case basis

After we confirm the workshop is guaranteed to run:
– Your commitment is secured
– Venue has been booked and costs incurred
– Physical materials are being prepared
– Printed book will be provided on the day
– No automatic refunds, but we understand life happens-contact us to discuss

On workshop day:
– Physical book and materials are provided regardless of attendance
– No refunds available for no-shows

3.3 Why We Have These Policies

We want to be transparent about why these timelines matter:

Online Workshops:
– We send exclusive digital materials (eBook, handouts) 48 hours before the session
– Once you receive these materials, particularly the proprietary eBook, the intellectual property has been shared
– This is why we can't offer refunds after materials are delivered-the value has been transferred to you

In-Person Workshops:
– Venue booking in Thailand requires advance commitment and deposits
– We order physical books and print materials based on confirmed participants
– Catering and room setup are arranged ahead of time
– These costs are incurred whether or not you attend

We're not trying to be rigid-we're a small team making careful commitments based on your enrollment. Your payment helps us make those commitments confidently.

3.4 Extenuating Circumstances

Life doesn't always go according to plan, and we understand that. We may consider refund requests outside our standard policy for:

– Medical emergencies (documentation may be requested)
– Bereavement or urgent family situations
– Natural disasters or force majeure events
– Government-imposed travel restrictions
– Other extraordinary circumstances beyond your control

We can't guarantee refunds in these situations, but we commit to reviewing each case with empathy and finding a solution where possible. This might include:

– Transferring your registration to a future session
– Providing a partial refund or credit
– Working out an alternative arrangement

Please contact us directly-we prefer conversation over automatic rejections. Reach us via WhatsApp or email (Section 12) and let's discuss your situation.

3.5 Program Cancellation by Us

We reserve the right to cancel or postpone any program due to:

– Insufficient enrollment
– Instructor illness or unavailability
– Venue issues (for in-person workshops)
– Unforeseen circumstances or emergencies

If we cancel a program:

– You will receive a full refund (no exceptions)
– We'll notify you as soon as possible (minimum 48 hours notice when feasible, often more)
– Refunds processed within 5-10 business days
– No materials will be distributed for cancelled programs
– We'll offer you priority enrollment in the rescheduled session if you're interested

For in-person workshops specifically:

– If we cannot confirm the workshop will run (insufficient enrollment, venue unavailable), you'll be notified before we collect payment
– If payment has already been collected, immediate full refund

3.6 Rescheduling

We try to accommodate schedule changes whenever possible:

If we need to reschedule a program, you'll have these options:

– Attend the rescheduled session at no additional cost
– Transfer your registration to a different program of equal or lesser value
– Receive a full refund

Please notify us of your choice within 7 days of receiving our rescheduling notice.

If you need to reschedule your attendance:

Online workshops:
– Rescheduling allowed up to 48 hours before the program start time
– Contact us to check availability in future sessions
– One complimentary reschedule permitted; additional changes may incur a fee
– Not possible once materials have been delivered (<48 hours before start)

In-person workshops:
– Contact us as soon as you know you need to change
– Before payment: Easy to accommodate
– After payment but before "guaranteed to run" confirmation: We'll work with you
– After confirmation: Transfer to next session if space available, or handled case-by-case

We genuinely want you to attend when you're ready and able. Let's talk if you need flexibility.

3.7 Refund Processing

All approved refunds are processed through Stripe and returned to your original payment method.

Refund Timeline:

– Stripe processes refunds immediately upon our approval
– Funds typically appear in your account within 5-10 business days
– Exact timing depends on your bank or card issuer
– You'll receive a refund confirmation email from Stripe

Please note:

– Stripe payment processing fees (typically 2.9% + applicable local fees) are non-refundable
– We cannot expedite refunds-timing is determined by your financial institution
– For international payments, currency conversion may affect the final amount

3.8 Partial Refunds

We don't offer partial refunds for:

– Partial attendance (arriving late, leaving early)
– Missed sessions or portions of multi-day programs
– Materials received but program not attended
– "I didn't like it" after the program has started

Programs are designed as complete experiences, and the value is in the full participation. We price our workshops fairly for what's included-if you're unsure, please reach out with questions before registering.

3.9 Intellectual Property and Materials

For online workshops:

Once digital materials are delivered (48 hours before program start), they cannot be returned or revoked. These include:

– Exclusive eBook: "Emergent Systems Thinking and Authentic Practice with Right Attention: A Primer for Systems Work" by Victor Nuñez (€42 value)
– Workshop handout with frameworks and tools
– Program access credentials

For in-person workshops:

Physical materials are provided on the day of the workshop:

– Printed paperback copy of "Emergent Systems Thinking and Authentic Practice with Right Attention: A Primer for Systems Work" (€42 value)
– Workshop handout and tools
– Materials provided remain yours regardless of whether you complete the full program

This is why we can't offer refunds once materials are distributed-the intellectual property value has been transferred to you, and these materials are exclusively available through our training programs.

3.10 Chargebacks and Payment Disputes

Please talk to us before disputing a charge with your bank. We're human, we make mistakes sometimes, and we want to make things right.

If you initiate a chargeback without contacting us first, it creates significant administrative burden and costs for our small team. This may result in:

– Immediate suspension of access to materials and programs
– Ineligibility for future program enrollment
– Administrative fees to recover chargeback costs
– In cases of fraud, we may pursue legal remedies

We'd much rather have a conversation. Contact us on WhatsApp or email, explain what happened, and we'll work it out together. We've never had a dispute we couldn't resolve through communication.

For Stripe-specific payment issues (declined cards, processing errors, currency questions):

– Try contacting us first-we can often help
– You may also contact Stripe support directly for technical issues
– We're not responsible for Stripe's processing decisions, but we'll assist where we can

3.11 Non-Refundable Situations

We cannot provide refunds in these circumstances:

– No-shows: Failure to attend without prior notice (48+ hours for online, or contact us for in-person)
– Late cancellations: Less than 48 hours before online workshops; after payment confirmation for in-person
– Materials already received: Once you've accessed/downloaded digital materials or received physical materials
– Voluntary withdrawal mid-program: After the program has started and you've participated
– Policy violations: Removal from the program due to disruptive behavior or Terms violations
– "Changed my mind": After materials have been delivered or after payment for confirmed in-person workshops

3.12 How to Request a Cancellation or Refund

For cancellations within the allowed timeframe:

– Online workshops (>48 hours before): Use the Acuity booking system link in your confirmation email, or contact us
– In-person workshops: Contact us directly-we handle these personally

For situations requiring discussion (extenuating circumstances, special requests):

Contact us with:

– Your order/registration number (from confirmation email)
– Name and email used for registration
– Brief explanation of your situation
– What outcome you're hoping for
– Best way to reach you (WhatsApp or email)

We'll respond within 2-3 business days (excluding weekends and Thai public holidays). Often faster.

Reach us:

– Email: [your email]
– WhatsApp: [your number/link] (fastest response)
– Hours: Monday-Friday, 9 AM - 6 PM Bangkok time (ICT)

3.13 Our Commitment to You

These policies might seem detailed, but here's what we really want you to know:

– We're reasonable people. If something genuinely prevents you from attending, talk to us.
– We value relationships over rules. Policies protect both of us, but they're not meant to be rigid walls.
– We're a small team. We remember each participant and care about your experience.
– We want you to succeed. If you're not getting value from what we offer, that's important to us.
– Communication solves most things. WhatsApp us, email us, talk to us-we'll find a solution together when possible.

Your enrollment supports our work and helps us continue developing and sharing the RAW Systems Work® methodology. We take that trust seriously and want to earn it through both the quality of our programs and how we treat you as a participant.

Thank you for being part of this community.

We're all here to learn and grow. We expect participants to:

– Be respectful of everyone's perspectives and experiences
– Participate actively and constructively
– Be present (minimize distractions, don't multitask)
– Ask questions and engage with curiosity
– Support other participants' learning
– Maintain confidentiality about others' sharing

7.2 What's Not Okay

We won't tolerate:

– Harassment, discrimination, or disrespectful behavior
– Disruptive conduct that interferes with learning
– Recording sessions without permission
– Sharing other participants' information or stories
– Using workshops to pitch your products or services
– Any behavior that makes others feel unsafe or unwelcome

7.3 If There's a Problem

If you experience or witness concerning behavior:

– Let us know immediately (during or after the workshop)
– We'll address it promptly and appropriately
– We take these situations seriously

If your behavior is disruptive or violates these standards:

– We'll speak with you about it
– Continued issues may result in removal from the program
– No refund will be provided if you're removed for conduct violations

We want to maintain a space where everyone can learn and grow.

8. Limitation of Liability

8.1 What We're Responsible For

We're committed to delivering quality programs and treating you with respect. If we make a mistake or fall short, we'll make it right where we reasonably can.

We're responsible for:

– Delivering the program as described
– Providing the materials we've promised
– Processing refunds when our policy requires it
– Treating your information properly

8.2 What We're Not Responsible For

We're not liable for:

– How you apply what you learn in your work
– Results or outcomes from using our methodology
– Technical issues beyond our control (internet outages, platform failures)
– Your travel or accommodation costs for in-person workshops
– Opportunities or business lost due to program cancellation or rescheduling
– Issues arising from third-party services (Stripe, Zoom, venues)

8.3 Limitation Amount

To the maximum extent permitted by law, our total liability to you for any claims related to our services is limited to the amount you paid for the specific program in question.

This doesn't limit liability for things we legally can't limit (fraud, gross negligence, etc.).

8.4 No Guarantees

We believe in our methodology and teach it with integrity, but we can't guarantee:

– Specific professional or business outcomes
– That you'll achieve particular results
– Employment or career advancement
– That the methodology will work for every situation
– That you'll like or agree with everything we teach

Learning is a personal journey. What you get out of it depends on what you put in and how you apply it.

8.5 Your Responsibility

You're responsible for:

– How you apply what you learn
– Decisions you make based on program content
– Your own professional judgment and ethics
– Compliance with laws and regulations in your jurisdiction
– Results of using the methodology in your work

We're educators, not advisors for your specific situations.

9. Force Majeure

Sometimes things happen that none of us can control-natural disasters, pandemics, government actions, wars, or other major events.

If something like this prevents us from delivering a program, we'll work with you to:

– Reschedule to a new date
– Move an in-person workshop online if possible
– Provide a full refund if we can't deliver the program

We're not liable for delays or cancellations caused by circumstances genuinely beyond our control.

We'll communicate clearly and quickly if any force majeure situation affects your program.

10. Governing Laws and Jurisdiction

10.1 Which Laws Apply

These Terms are governed by the laws of Thailand. We're a Thai company (Labkom Co. Ltd.), and Thai law is what we know and can work with.

10.2 Resolving Disputes

If we have a disagreement, let's talk first. Seriously-most issues can be resolved through conversation.

If we can't work it out between us:

– We'll try mediation before going to court
– If legal action becomes necessary, it will be in the appropriate courts in Bangkok, Thailand
– Both parties agree to this jurisdiction

We really hope it never comes to this. We'd much rather find solutions together.

10.3 International Participants

If you're participating from outside Thailand:

– These Terms still apply
– Thai law still governs
– You agree to Thai jurisdiction for disputes
– We'll work with you to find reasonable solutions that account for distance and time zones

We serve an international community, and we understand the complications that can create. We'll be practical and fair.
